GETTING A GOVERNMENT WE DESERVE. By Oro Governor – Honorable Gary JUFFA

Preparation for a Government should start early, if one is not satisfied with what they have now. I am not claiming to be the answer nor do I know the answer but I feel convinced that this is most certainly what is needed: preparation. We do need good people to be good leaders. People who care and will not sell [PNG] Goilala, people who will be intelligent enough to identify the problems and brave enough to have the determination to address those problems, people who can recognize threats to our economy and future and find means to mitigate them, people who can also seek and seize opportunities and promote and protect our economy.

People get the government they deserve it is said, so if we feel we deserve a government that SERVES us, then we need to make that effort to GET it…that effort needs to start now….let us not be swayed by emotion and rhetoric but let us be shrewd and plan and get up out of our comfort zones and start the process, commit resources and effort and make it happen…there are so many good people who have the capability and skills and qualities to be good leaders, men and women, they need to be identified and screened and moulded and prepared and eventually, elected.

Even then, they must be monitored and guided in their efforts, not discouraged or exasperated by expectations that are unrealistic….it CAN be done…if we want a better tomorrow…for our children…otherwise, we must accept, that this great nation we call home, will most certainly go to the dogs…sold off chunk by chunk, by uncaring politicians and their transnational criminal cronies….

So how can you help? I often hear from exasperated people that there is “too much talking” and not enough action. This may be true, but talking is one of the first steps that are needed and talking MUST continue even when action is taking place.

I believe that the 2017 Elections will be very much influenced by Social Media. Many may scoff at this perhaps outrageous prediction but think about it and you will agree. Everyone of you here has the ability to influence those who are not on FB and who do VOTE. The masses. They rely on us for their issues of concern. School fees, bail, compensation, deaths, births, marriages etc. They listen to their kin who are educated. They can be influenced. You can make a list and you will find that it is quite significant. Social Media is not only here to stay, it is here to make a difference. It is up to you how that will be. You could use it to influence decisions at the ballot. You could use it to influence the make up of the next Government.

And so if you want the Government you deserve, you will have to make a concerted effort to GET it…

IGNORANT GOILALAS GET SWAMPED AND THEY LIKE IT THAT WAY – TOLUKUMA GOLD MINE

Tolukuma Gold Mine has been in operation in our District for more than a decade now.

1995 is the year I recall when Tolukuma Gold Mine came into operation. And since that time until now various operators have come in and gone leaving Goilalas, especially the local landowners and surround areas virtually unchanged.

Woitape Local Level Government council been the host LLG has no visible sign of the so called TGM SSD grants been turned into something physical for people to see, touch, feel and use. Nothing tangible has been built or developed to enforce the community obligation that the TGM operator(s) has had over the years.

Goilala District, precisely Tolukuma Gold Mine, should be better termed as a GOLD WHORE where by losers and cheap thieves can come and sleep out a night with her, suck out all the juice that the previous client left of her and leave the next day only to make way for the next thirsty blood sucking low life.

But that is not to say the clients [operators] that come in to operate and extract the Gold from under the rocks and mountains of Tolukuma are merely penny less clients. If they can come from far and wide just to get a piece of the pie, no ordinary man would travel such a distance. Only the rich and experienced with a bag full of money can travel such a distance.

So where is the problem then that every operator of TGM since 1995 has one thing in common. They have left Tolukuma Gold Mine and its surrounding areas literally un-developed and under-developed

So it’s not really the fault of the operators is it?

“SUPREME COURT GRANTS NAMAH STANDING TO MAKE APPLICATION” – SUPREME COURT – PNG

Justice Sakora granted the leader of the Opposition, hon. Belden Namah’s request for a declaration to the effect that Mr. Namah has Standing to make application in the Court House, Court Room 1 this morning [29 January 2014, Port Moresby, Papua New Guinea.]

This is in contrast to a similar application by Mr. Namah filed earlier in 2013, which was dismissed by the court (Cannings J, Kassman J, Murray J), upon upholding an objection by the same respondents to its competency (Belden Norman Namah MP v Rimbink Pato MP (2013) SC 1241).

This is following applicant, Mr. Namah’s pursuant to Constitution, Section 18 (1) regarding the Asylum Centre in Manus, where Respondents were namely:

1. Minister for Foreign Affairs & Immigration, Rimbink Pato, MP,
2. The National Executive Council
3. and the Independent State of Papua New Guinea. Judges who delivered the reading today were Justice Sakora and Justice Cannings;

Initially a five (5) men Supreme Court Bench ruled in favour of the Opposition Leader today. Counsels representing the Applicant and Respondent were Henao Lawyers for the Opposition Leader and Kuman Lawyers for the Respondents.

During the hearing, Justice Sakora read that the Leader of the Opposition filed an application in the Supreme Court under Section 18 (1) of the Constitution seeking declarations as to the constitutionality of arrangements, including Memoranda of Understanding between the government of Australia and Papua New Guinea as to the transfer of persons seeking asylum in Australia but are instead transferred to PNG from Australia for processing.

Justice Sakora proposed to argue that those arrangements are unconstitutional as they are contrary to the rights of the transferees to personal liberty under Section 42 (1) of the constitution: RIGHTS OF ALL PERSONS 42. Liberty of the Person (1) No Person shall be deprived of his personal liberty except – (and it lists reasons including where the person is unfit to plead to a criminal charge or other instances where the person is implicated, for contempt of court execution of the sentence or order of a court in respect of an offense he has committed and etc.)

However, before an application under Section 18 (1) of the Constitution can be heard, the Supreme Court Rules 2012 require that the court should declare that the applicant has standing which is a matter at the discretion of the Supreme Court again, to be exercised in accordance with the rules of the underlying law formulated in Re Petition of MT Somare [1981] PNGLR 265.

The Somare Rules used as are as follows: a) The applicant will have standing if he or she has sufficient interest in the matter, which will be demonstrated if the applicant; • Has personal interests or rights that are directly affected by the subject matter of the application; or • Is a citizen who has a genuine concern for the subject matter of the application; or • Is the holder of a public office, the functions of which relate to the subject matter of the application.
b) The application must raise significant (not trivial vexatious, hypothetical or irrelevant) constitutional issues.
c) The applicant must not be a mere busybody meddling in other peoples affairs and must not be engaged in litigation for some improper motive, e.g. as a tactic of delay.
d) The fact that there are other ways of having constitutional issues determined by the Supreme Court does not mean that a person should be denied standing.

In determining the standing of the Opposition Leader, Justice Sakora preceded as such that when applying the four Somare rules to the case;

a) The applicant has a sufficient interest as he is a citizen who has a genuine concern for the subject matter of the application;
b) He wishes to raise significant constitutional issues;
c) He is not a mere busybody and he has no improper motive;
d) Though there are at least three other ways of having the constitutional issues determined by the Courts, this does not mean that he should be refused standing.

Therefore the applicant, Mr. Namah’s request for declaration of standing to make the application was granted; As was the Judgment accordingly: Order:
(1) The applicants request is granted.
(2) It is declared that the applicant has standing to make the application.
(3) The respondents shall pay the costs of and incidental to the hearing of the request to the applicant, on a party-party basis, which shall, if not agreed, be taxed.

MONA INVESTIGATE SOURCE OF STUDENT PETITION

The petition to the Member for Goilala, Daniel Mona by the students of Tapini Sacred Heart School is thought to be the doing of one person and has been considered unnecessary.

In a recent phone interview with Hon. Mona’s Executive Officer, Mr. John Mona said there are suspicions towards the formation of the petition by the students of TSHS.

He said the Education Department has already been made aware of the petition and is currently carrying out investigations on this matter.
“How can a grade eight student write up a petition like this?” the EO questioned.
“We will find out who exactly did up this petition and forced the students into signing it.”
“Media should not waste their time on publishing stories without substantial information.”

While the political matter on who should control Goilala continues, the future of the students from Tapini Sacred Heart School will remain blurred and so will the future of the entire Goilala District.

LACK OF DEVELOPMENT. Whose FAULT is IT?

Most of the time, lack of development, progress and change are blamed on the politicians with Governments Public servant machinery in place and then the corrupt systematic and systemic networks/syndicates that exists within the public service system.

But when we look at it closely enough, some of the finger points should squarely fall back on the customary chives [aka thieves] and the villager elders, councilors, leaders and those who are supposed to ensure these amenities are taken care of and looked after.

There are some crooks who collude with equally corrupt government officials who work in the MPs Office, and government Offices as project officers, to systematically divert funds into personal accounts and siphon those monies and use it for personal gain.

The paper work does states that its for a “Aid Post upgrade/maintenance” but in reality, this funds are used up in clubs, poker machines and hotels down in Pom.

Part of the blame does fall on the MP and District Administration of course. But most of the blame has got to fall squarely on the so called VILLAGE LEADERS.

We can point fingers at the politician all the time. But we got to do some in-house cross checking and cross referencing before we can then point a finger at them.

Double Dipping and Pre Commitment.

Goilala District’s newly elected MP Daniel K Mona, while he may seems flowery out on the main stream media, his in-house office administrations is nonetheless nonexistent or is been hijacked.

Out of the 13 staff members MP has in his office, most Goilalas are either drivers or normal admin staff. MP Mona’s small brother John Mona seem like the go to man with his backup personnel Perai Manai, who word has it is the First Secretary for MP Mona. The facts are John Mona and Perai Manai are two secondary secretaries to the Office of the Shadow Ministry of Education, Science and Technology. This has nothing to do with Goilala MP Office staff membership.

But hey, hold on. The member has an Executive Officer. Back ground checks on this individual traces back to Member Ano Pala in the previous term. This individual also had a stint with the former Governor for Western Province during his tenure. This individual also had a hand in systematically interfering with scope of works funds for the Kwikila Station Health Center rehabilitation projected funded by AusAid for his own use.

When it all seem rosy this far out, it does not stop here. The Executive Officer for Goilala MP Daniel K Mona had a hand in ensuring his biological son is the official First Secretary for Goilala MP’s office, earning a hefty sum of K1000.00 a fortnight.

The clown act does not stop here. It is a known fact also that MP Mona’s Wife is also a Second Secretary to the MP. Now this is when it gets confusing. Two second Secretaries? No. Mrs. Mona is the Second Secretary for the Office of MP for Goilala and the Rigo guy’s son is the First Secretary to the MP Mona. And is on the payroll. But isn’t this Mrs. Mona the same person who is employed by Central Province Disaster Office? And is also on the payroll there? This is obviously a case of double dipping and a conflict of Interest situation on show.

Having learnt and earned the tricks and tips, the Executive Officer for Goilala MP, had advised MP Mona to go on a Pre commitment Drive, where by vehicles are hired and hotels are booked and pledges made on a pre committed arrangement.

Pre Commitment is about utilizing some service well before payment is made. This obviously means, all DSIP funds are been committed already well away from the knowledge of the Goilala District JDP and the Goilala District Administrations attention.

This is risky business and leaves Goilalas venerable to the prey of a seasoned crook who knows his trade of colluding and siphoning funds out well before anyone takes notice.
The K10million DSIP funds ear marked for Goilala District and its People are well and truly pre committed and exhausted even before this fund hits our Goilala District Account.

Most of the crucial decisions made by the recently elected MP for Goilala, Daniel K Mona, have the finger prints of two people. The Executive Officer and the Second Secretary. The Goilala District JDP Committee and the Goilala District Administration does not have a say in nearly all the decisions made thus far.

By the way, with the early signals and warnings sent out, it seems eminent Goilala District Political affairs, financial affairs, economical affairs and even our MPs personal affairs will be masterminded by Rigos. Word coming through has it that Incumbent District Administrator has been replaced by someone who is known to have a shady background when he was previously employed by previous Central Provincial regime in the capacity of a Deputy Provincial Administrator.

Does these calls for some drastic actions? Yes, it really calls for some desperate drastic action, right here and NOW.
